In June 2014, comedian Tracy Morgan was critically injured after being involved in a deadly bus crash with his friend James McNair. Now, E! News reports James McNair's family has received a $10 Million settlement from Walmart, after 62-year-old McNair, Morgan's friend and fellow comedian, died when Morgan's tour bus crashed into a Walmart truck on the New Jersey turnpike. In January, McNair's family reached a settlement with Walmart, but now the amount in which his children, Jamel and Danita, received has been revealed.
Now we know McNair's estate received a $10 million payout based on documents filed in February 2015 at Westchester's Surrogate Court, per ABC News. On Friday, a Walmart spokesperson released the following statement to E! News:
We cannot discuss the terms and conditions of the settlement, but we are glad to have reached an agreement. We deeply regret the loss of Mr. McNair as a result of the accident. Walmart worked closely with his family to ensure their wellbeing. Walmart will continue to work to conclude all of the remaining issues and we're committed to doing what's right.
Of the $10 million settlement, McNair's children reportedly received $7 million, while their lawyer, Daryl Zaslow, took about a $3 million cut. For those wondering why the amount is now being announced, ABC News reports that Zaslow wanted the figure made public as a way to support his request for nearly $3 million in legal fees.
As for McNair's daughter, Danita, she said, "While no amount of money could replace my father, the amount of money Mr. Zaslow was able to obtain again greatly exceeds anything I imagined and I could not be more grateful."
Regarding Morgan, he filed a lawsuit against Walmart in July 2014, but it has yet to be settled.
